Terms of Service

1. Provider and contact

RapidNet operates hosting infrastructure from Erbil, Kurdistan Region, Iraq. Questions, legal notices, and abuse reports may be sent to [email protected] or through the authenticated support portal.

2. Eligibility and account responsibility

You must be at least 18 years old and legally able to enter a contract. Account, identity, billing, and contact information must be accurate and kept current. You are responsible for activity performed through your account, credentials, services, applications, and users.

Protect passwords and API credentials, enable available multi-factor authentication, and promptly report suspected compromise. RapidNet may request reasonable verification before provisioning, changing ownership, or restoring access.

3. Services and exclusions

VPS plans provide the virtualized resources stated in the order. Unless a written managed-services agreement says otherwise, VPS services are self-managed: you are responsible for the operating system, applications, security configuration, updates, licensing, data, and backups.

Shared web-hosting plans are intended for ordinary websites and web applications. They include the website, database, file, DNS, SSL, and cPanel email features stated in the order. Mailbox counts, per-mailbox limits, and sending limits depend on the selected plan, and mailbox data counts toward its total hosting storage. Email service may not be used for spam, phishing, unsolicited bulk messaging, credential theft, or attempts to evade provider or recipient protections. Customers must secure mailbox credentials and keep DNS authentication records accurate. Delivery to any particular recipient is not guaranteed because external providers apply their own reputation, filtering, and acceptance rules.

4. Acceptable use

You may not use RapidNet services to create, host, transmit, facilitate, or promote:

• activity that violates applicable law, a binding court order, or the rights of another person;
• fraud, impersonation, phishing, unsolicited bulk messaging, credential theft, or deceptive schemes;
• malware, botnets, denial-of-service activity, unauthorized access, unauthorized vulnerability scanning, or attempts to bypass security controls;
• child sexual abuse material, sexual exploitation, grooming, trafficking, non-consensual intimate material, or any other illegal sexual content;
• pornography, sexually explicit adult entertainment, or services whose principal purpose is distributing or monetizing explicit sexual material;
• credible threats, incitement to violence, targeted harassment, or exploitation of vulnerable people;
• material that infringes copyright, trademark, privacy, confidentiality, or other enforceable rights;
• cryptocurrency mining or similarly intensive activity that materially harms shared infrastructure or network stability.

These restrictions apply to conduct and content, not to a person's identity or protected characteristics.

5. Web-hosting workload restrictions

Shared web hosting is not a video-hosting, streaming, transcoding, media-distribution, backup, archive, file-mirroring, download portal, CDN, or general-purpose storage service. Ordinary images, downloads, and media that directly support a legitimate website are allowed when they remain within the purchased plan and do not dominate resource or transfer usage.

RapidNet may require a workload to move to a suitable VPS or another service when it creates sustained CPU, memory, disk, process, database, or network pressure that affects other customers.

6. Security, software, and licensing

You must keep software supported and patched, use lawful licenses, secure administrative access, and respond to compromise or abuse notices. You may not interfere with monitoring, metering, isolation, or platform security. RapidNet does not authorize testing against systems you do not own or lack written permission to test.

7. Orders, payment, renewal, and taxes

Prices, billing periods, resource limits, and one-time fees are shown during checkout. Charges are due by the invoice date. Services may be suspended or terminated for non-payment after applicable notices. You are responsible for taxes or government charges that legally apply to your purchase, excluding taxes imposed on RapidNet's own income.

A refund is available only when required by applicable law or expressly stated in the order or a published refund commitment. Cryptocurrency and other irreversible payment methods cannot be reversed by RapidNet after settlement.

8. Backups and customer data

Unless the order expressly includes a backup service, backups are not included. Any convenience snapshot or platform copy is not a substitute for an independent, tested backup. You are responsible for keeping recoverable off-service copies of important data. RapidNet may delete data after termination, expiry, or a reasonable retention period without further obligation, subject to applicable law.

9. Suspension and termination

RapidNet may limit, suspend, quarantine, or terminate a service when reasonably necessary to address security threats, abuse, non-payment, material breach, legal requirements, or harm to the network or other customers. When circumstances permit, we will provide notice and an opportunity to correct the issue. Immediate action may be taken where delay would increase harm, violate law, or endanger systems or people.

10. Complaints and lawful requests

We review sufficiently detailed abuse complaints and lawful government or court requests. We may preserve or disclose information when required by applicable law, a valid legal process, or an emergency involving a credible risk of serious harm. Where legally permitted and operationally reasonable, we seek to limit disclosures to information relevant to the request.

11. Availability and changes

Maintenance, upstream failures, attacks, software faults, and events outside reasonable control may interrupt service. Any service-level commitment applies only when explicitly stated in the order or a separate written agreement. RapidNet may make reasonable changes needed for security, law, compatibility, or network operation and will provide notice of material customer-impacting changes when practicable.

12. Disclaimers and liability

To the maximum extent permitted by applicable law, services are provided on an “as available” basis without warranties not expressly stated in writing. RapidNet is not responsible for customer applications, configuration, content, lost profits, lost business, or indirect or consequential loss. RapidNet's aggregate liability arising from a service will not exceed the amount paid for that affected service during the three months before the event giving rise to the claim, unless applicable law requires a different result.

13. Governing law

These Terms are governed by the applicable laws of the Republic of Iraq and the Kurdistan Region of Iraq, without limiting mandatory consumer protections that cannot lawfully be waived. Unless mandatory law requires another forum, disputes will be submitted to the competent courts in Erbil.

14. Updates and severability

We may update these Terms for legal, security, operational, or service changes. The effective date above will be revised, and material changes will be communicated through the website, client portal, or account contact where practicable. If one provision is unenforceable, the remaining provisions continue to apply.
